Drunken Driving Accident Victim Sues Family of Negligent Driver


On February 5, 2009 a Massachusetts woman who was visiting family in Florida was struck from behind by a high school student who was driving drunk. The woman was flown to Tampa General Hospital to be treated for the serious head injuries.

The driver left the scene of the accident, but was pulled over later that evening by police who caught him traveling 80 mph in a 45 mph zone. As police approached the car, they heard a loud gunshot. When they got to the car, they found the 18-year-old boy suffering a self-inflicted gunshot wound to the head.

The driver was also taken to a local hospital where he was pronounced dead. According to Florida law, since the car belonged to the mother of the driver, she can be held responsible for the accident. The lawsuit being filed by the victim and her personal injury attorney, is holding the mother responsible for allowing her son to drive while intoxicated.

This case is obviously painful to both families involved. While one has suffered injuries that may never heal correctly, another is mourning the loss of a son whose actions have had a twofold effect: a funeral and now a lawsuit.

While one never wants to see young people die in this manner, the victim is the woman who was struck and deserves compensation. It’s unfortunate that it has to involve a family still reeling from their son’s death.
