Wyoming Personal Injury Overview

Personal Injury Lawyers - Representing People Nationwide

Personal injury law is a very broad area of law that covers accidents and injuries related to vehicle accidents, medical malpractice, product liability and premises liability. While the basic laws of personal injury are the same from state to state, there are some aspects of the law that vary.

In Wyoming, if you have suffered a personal injury due to someone else's negligence or wrongdoing, you may be compensated for:

  • Past and future medical expenses
  • Lost wages
  • Lost earning capacity
  • Permanent disfigurement and disability
  • Pain and suffering
  • Emotional distress
  • Loss of enjoyment of life
  • Property damage

Negligence Issues

According to the doctrine of "modified comparative negligence," you still can collect compensation even if you are partly to blame for your injuries. You must be less than 50% responsible for your injuries to collect from other responsible parties.

In Wyoming, the doctrine of "several liability" applies and states that each party is to be held financially responsible for their share of the damages. If one party fails to pay, however, you cannot seek his share from the other parties.

Statute of limitations

All states have time limits, called statute of limitations, to file a personal injury lawsuit. Once the statute of limitations expires, you can no longer file. You have run out of time, so to speak. In Wyoming, you have four years from the date of the injury to file a personal injury lawsuit. There may be exceptions to this time limit for medical malpractice cases and cases involving minor children.
