New York State Dog Bite Laws:
In New York, a dog owner may be subject to common law liability, based on negligence, for damages caused by his/her dog when the dog bites or injures a person. In other words, where a dog owner knows, or should have known, of his/her dog's vicious propensity, the owner may be subject to liability for the injuries caused by the dog. In cases where the owner does not know of the dog's vicious nature, the victim must demonstrate that the owner was negligent and that this negligence caused the attack. In addition to common law liability, a dog owner who negligently allows his/her dog to bite someone may be subject to a civil penalty.
The authorities in New York are able to declare a dog as being "dangerous." The owner of a dog declared to be "dangerous" is strictly liable for medical expenses resulting from an injury caused by the dog, as long as the dog attacked without justification. The owner of a dangerous dog must also meet certain legal requirements. The owner must neuter or spay the dog, microchip the dog, and may be required to have the dog evaluated by a certified applied behaviorist or veterinary behaviorist. The courts may also require the owner to properly restrain the dog with a leash and muzzle whenever the dog is on public property and maintain a liability insurance policy to cover any damage caused by the potentially dangerous dog.
