Michigan State Dog Bite Laws:
In Michigan, a dog owner is subject to strict liability for damages caused by his/her dog when the dog bites or injures a person, but only if the injured person is lawfully present on private property or the injury occurred on public property. This liability applies regardless of the dog owner's knowledge of the dog's former viciousness or vicious propensities. A person is considered to be lawfully on the owner's property if he or she was invited to be there, such as a friend or a repair person. A trespasser is not considered a lawful guest of the owner. A dog owner is probably not liable, however, for injuries sustained by a person if that person provoked the dog, causing the dog to attack. Dog bit victims in Michigan may seek damages both under Michigan's dog bite statue, as well as under a common law theory of negligence where the victim is able to prove that the owner's negligence caused the injury.
A dog that caused serious injury or death to a person or another dog shall be ordered destroyed by the appropriate Michigan court. A dog that has not caused serious injury or death, but has previously been found to be a dangerous dog or is likely to cause serious injury or death in the future, may be ordered destroyed by the appropriate Michigan court. The owner of a dog known to be dangerous must meet certain legal requirements. The court may order the owner to register the dog with the Michigan Department of Agriculture, be tattooed, be sterilized, require the owner to obtain and maintain liability insurance, be enclosed on the owner's property, or take other appropriate action to protect the public.
