If the victim's actions did play a part in the dog attack, the damages are only reduced if the judge determines that the fault of the victim exceeded the negligence of the dog owner. After a dog has injured a person, a court may conduct a hearing to determine if a dog is dangerous. After the hearing, the judge may order the dog to be muzzled, restrained, confined indoors, or confined outdoors in an enclosure. Depending on the severity of the injury, the judge may order the dog to be destroyed. If the owner fails to comply with the orders of the court, and the dog subsequently injures another person, the owner may be required to pay the injured person triple the amount of damages suffered.
