Massachusetts State Dog Bite Laws:
In Massachusetts, a dog owner may liable for damages caused by his/her dog when the dog bites or injures a person, but only if the injured person was not trespassing at the time of the bite or injury. Additionally a dog owner is probably not liable for injuries sustained by a person if that person provoked the dog, causing the dog to attack. Massachusetts law presumes that, when the victim is a child under the age of seven years old, that child was not trespassing or provoking the dog. The burden then shifts to the dog owner to prove that the child was indeed trespassing or provoking the dog.
Local authorities in Massachusetts have the authority to issue orders regarding the control of certain dogs. For example, a local authority may order a particular dog to be restrained. If that dog is ordered to be restrained, but injures a person after the order, the owner will be liable for three times the amount of damages sustained by the victim.
