The state of Kentucky requires automobile drivers to purchase bodily injury liability coverage and property damage liability coverage. At a minimum, the driver must have bodily injury liability coverage of at least $25,000 per person injured in any one accident and $50,000 total for all persons injured in any one accident. Additionally, the driver must have a minimum of $10,000 property damage liability coverage for the destruction of the property of others as a result of an automobile accident. This is often represented as 25/50/10 coverage. Kentucky state law requires the purchase of personal injury protection coverage with a minimum amount of $10,000 to cover reasonable and necessary medical expenses sustained by the policyholder or the policyholder's passengers, regardless of the number of people injured.
Kentucky is unique in that drivers may choose between a "split limit" and a "single limit" policy. The split limit policy is the 25/50/10 coverage described above. The single limit policy allows policyholders to purchase coverage with a single limit of $60,000 per accident for all damages sustained in that accident. Kentucky also follows a Choice No-Fault system. Under this system, drivers may choose to reject the standard No-Fault system and, instead, retain the right to sue under the general theory of tort law (based on demonstrating negligence of another) for injuries sustained in an auto accident.
Automobile drivers have the option of purchasing uninsured motorist or underinsured motorist bodily injury coverage. This type of insurance is meant to cover bodily injuries caused by an uninsured or underinsured driver. If a person chooses to purchase uninsured motorist coverage, the coverage may be purchased in any amount not less than the amount of bodily injury coverage purchased. There is no minimum amount of coverage required by law for underinsured motorist coverage.
