Delaware Auto Insurance Attorney

Delaware law requires drivers to carry three primary types of automobile insurance: bodily injury liability, property damage liability, and personal injury protection. At a minimum, the driver must have bodily injury liability coverage of at least $15,000 per person injured in any one accident and $30,000 total for all persons injured in any one accident. Additionally, the driver must have a minimum of $10,000 property damage liability coverage for the destruction of the property of others as a result of an automobile accident. This is often represented as 15/30/10 coverage. As to personal injury protection coverage, at a minimum, drivers must purchase insurance adequate to compensate the insured, passengers riding in the insured's vehicle, and pedestrians for medical expenses resulting from an accident in the amount of $15,000 per person in any one accident and $30,000 for all people injured in any one accident. Personal injury protection coverage must also include coverage for funeral expenses (not to exceed $5,000 per person) and for lost earnings.

Automobile drivers have the option of purchasing uninsured motorist or underinsured motorist bodily injury coverage. This type of insurance is meant to cover bodily injuries caused by an uninsured or underinsured driver. If a person chooses to purchase uninsured/underinsured motorist coverage, the coverage purchased may not be less than the minimum limits required for bodily injury and property damage liability insurance. The amount of uninsured/underinsured motorist coverage may not exceed the amount of bodily injury coverage purchased by the insured.
