Family Wins Medical Malpractice Suit against Government - Wednesday, April 7, 2010

An Illinois family has been awarded $29.1 million in a medical malpractice lawsuit against the federal government. The damage award will compensate their six-year-old son Christian who suffered severe birth injuries.

In 2003, Christian suffered brain damage while being born at Northwestern Memorial Hospital in Chicago. The brain injury has left him quadriplegic. He also developed cerebral palsy from the birth injury.

The lawsuit was somewhat unique among medical malpractice claims. Since the doctors involved in the incident worked for a federally funded clinic, the lawsuit was brought in federal court and the U.S. government was named as a defendant. The Federal Tort Claims Act allows injured victims to sue the federal government; however, these cases will result in a bench trial without a jury.

Birth injuries can have a long term impact on the victim's entire family. Often these injuries will permanently alter the child's quality of life. If long term care and follow-up medical attention is required, the injury can be financially crippling to the family as well.
