Woman Awarded $12 Million in Medical Malpractice Lawsuit - Tuesday, February 16, 2010
A California jury awarded Jessica Ramirez $12 million in a medical malpractice lawsuit. Ramirez suffered a severe brain injury in 2007 after waiting more than 5 hours at a local hospital for treatment.
The jury found Greater El Monte Community Hospital guilty of negligence in treating Ramirez, who was 22 at the time. She was shot in the head with an air gun. At the time she arrived at Greater El Monte Community Hospital, she was still conscious and able to walk around. She waited at the emergency room for five hours and never received treatment. She was eventually air lifted to a Pasadena hospital. By the time she arrived at the second hospital for surgery, she was minimally conscious.
The bleeding and pressure on her brain resulted in permanent brain damage, and she will need 24 hour care for the rest of her life.
The neurosurgeon who performed brain surgery at the Pasadena hospital testified that Ramirez's brain injury would not have been as severe if she had received more prompt treatment. Hospital officials at Greater El Monte Community Hospital deny any wrong doing and insist that their emergency room staff acted appropriately in their failure to treat Ramirez. They plan on appealing the verdict.
